These Terms of Service ("Terms") govern your access to and use of the BarGuard platform, website, and services (collectively, the "Service") operated by BarGuard ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
BarGuard is an AI-powered compliance scanning platform that analyzes attorney and legal services web pages against state bar advertising rules. The Service provides automated compliance scores, violation detection, rule citations, and remediation guidance.
The Service is for informational purposes only and does not constitute legal advice. Compliance determinations are generated by artificial intelligence and may contain errors, omissions, or inaccuracies. You should always consult a qualified attorney before making compliance decisions based on our analysis.
You must be at least 18 years old and have the legal capacity to enter into these Terms. By creating an account, you represent that the information you provide is accurate and that you will keep it current.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@barguard.ai if you suspect unauthorized access.
The free tier provides limited access to the Service, including up to 3 compliance checks per month on 1 monitored URL against 1 jurisdiction. Free scans may be used without an account and are subject to automatic deletion after 30 days.
Paid plans (Pro and Enterprise) offer increased usage limits, additional features, and priority support as described on our pricing page. Paid subscriptions are billed on a monthly or annual basis through our third-party payment processor.
Each URL scanned against a jurisdiction counts as one "check." If a page has not changed since the last scan (detected via content fingerprinting), the check is not counted against your monthly limit. Usage limits reset on your billing cycle date.
By subscribing to a paid plan, you authorize us to charge the payment method on file at the applicable rate. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

The Service, including its design, software, AI models, compliance rule databases, and documentation, is owned by BarGuard and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.
You retain ownership of any URLs, firm information, and custom compliance rules you submit. You grant us a limited, non-exclusive license to process this content solely to provide the Service to you.
Compliance reports generated by the Service are licensed to you for your internal business use and for sharing with your clients and legal counsel. You may not resell reports as a standalone product.
The compliance analysis, violation detection, severity assessments, confidence scores, and remediation suggestions provided by the Service are generated by artificial intelligence. While we strive for accuracy, you acknowledge and agree that:
BarGuard is not affiliated with, endorsed by, or representative of any state bar association, regulatory body, or government agency.
The Service integrates with third-party providers to deliver its functionality, including cloud infrastructure, AI model providers, web scraping services, and payment processors. Your use of the Service is also subject to the terms and policies of these providers. We are not responsible for the availability, accuracy, or practices of third-party services.
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described therein.
When you submit a URL for scanning, the page content at that URL will be retrieved, processed, and stored to provide the Service. You represent that you have the right to submit any URLs you provide for analysis.
The Service allows you to generate shareable compliance reports with unique links. You are responsible for controlling access to shared report links. Anyone with a shared report link can view that report's contents. We are not liable for unauthorized access resulting from shared links you distribute.
To the maximum extent permitted by applicable law, BarGuard and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of clients, regulatory fines, bar disciplinary actions, or reputational harm arising from:
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI analysis will be accurate or complete.
You agree to indemnify, defend, and hold harmless BarGuard and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
We may suspend or terminate your access to the Service at any time, with or without cause, upon notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Disclaimers) shall survive.
We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles. Any disputes arising from these Terms shall be resolved in the courts located in Delaware.
